Rhea Chakraborty Drug Case: Bail Granted To Actress; NCB Informs Supreme Court It Is ‘Not Challenging’

The Narcotics Control Bureau (NCB) informed the Supreme Court on Tuesday that it was not contesting the Bombay High Court's decision to grant actor Rhea Chakraborty bail in the cases brought against her in connection with a drug-related investigation linked to the death of actor Sushant Singh Rajput.

Justices AS Bopanna and MM Sundresh's bench heard from Additional Solicitor General SV Raju that NCB is not contesting the bail but that the legal issue surrounding Section 27-A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act should be left open.

"We are not challenging the grant of bail but on the interpretation of section, please keep it open for consideration. Let the order not be a precedent also," ASG spoke to the bench. The Supreme Court ruled in favor of the government and dismissed its appeal while making it clear that the decision of the Bombay High Court will not serve as a precedent.

The girlfriend of Sushant Singh Rajput, Rhea Chakraborty, was granted bail by the Bombay High Court in an order from October 2020 that was being challenged by the NCB. Chakraborty had been accused by the NCB of violating the strict Section 27-A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

The clause carries a maximum 10-year sentence in prison and a ban on bail approval. Simply paying for a particular drug transaction does not qualify as financing drug traffic, according to the High Court.

On June 14, 2020, Sushant Singh Rajput, 34, was discovered dead in his Bandra area flat. Rhea Chakraborty was accused of aiding in suicide by Sushant's parents, and a parallel investigation into her alleged drug purchases on the basis of her WhatsApp talks was launched as a result.
